The key takeaway is that Trump was able to shift the Overton Window as to who is entitled to birthright citizenship. Trump's order "prohibits federal agencies from recognizing citizenship for children born in the United States after Feb. 20, 2025, if their mother is unlawfully present and the father is neither a citizen nor a lawful permanent resident, or if the mother’s presence is temporary and the father lacks that status."
It is entirely consistent with contemporaneous writings/speeches of the authors of the amendment.
ReplyDeleteThe fact that the American Indian tribes were not considered citizens, even though the tribes existed within the borders of the United States, is proof that it was never intended that someone would become a citizen just by the fortune of being born within the borders.
