Sacramento Deploys Domestic Surveillance To Spy On Your Trash

The New York Post reports that "Sacramento deploys trash spies to snoop on homeowners so they comply with Newsom vision." From the lede:

    Sacramento residents are bracing for tight supervision of what they throw in their trash as Gov. Gavin Newsom’s mandates require the city to lay invasive eyes on them.

    Bin inspections are set to be deployed this month due to SB 1383, a law that requires local governments to take steps to reduce methane emissions caused by short-lived climate pollutants.

    One of the key goals of the initiative is to see if homeowners are sorting their organic waste properly. City officials say they caught many sorting their trash into the wrong bin.

I have no doubt but that they will be looking for evidence of other items to justify further surveillance or an arrest of particular households.

  2. Your last sentence above was interesting. I remember my professor talking about this subject when I was in the criminal justice program. I seem to recall the phrase "NO reasonable expectation of privacy." One has no control over what happens to their trash bin when it's left out on the curb overnight. Just as you are protected by law if someone puts contraband or a murder weapon in your trash bin...because you have no "reasonable expectation of privacy"...you also accept that anyone can access your trash when it's sitting out and easily accessible. I don't think law enforcement could use any evidence collected from a persons trash in a criminal case because whatever the trash inspectors might find (drug manufacturing materials etc.) are "beyond the scope of the search" which in their case is limited to organic materials and recyclables. JMHO and IANAL of course

    1. It isn't a "search" under the 4th Amendment because there is no expectation of privacy, so the restrictions on "searches" is inapplicable.
