Congress Abandons the Fifth Amendment

The Fifth Amendment provides, among other things, for due process when charged with a crime. However, the Atlantic notes that Congress has passed a bill (it is currently before a reconciliation committee) that allows for indefinite detention of terrorist suspects without trial or even formal charges. There had been an amendment that would have excluded American citizens, but the amendment was dropped--apparently with the blessings of civil rights groups, because it didn't extent  to everyone in the United States.
